Connecticut: Senator Bringing Back Affirmative Consent Standard

A bill that would require public and private colleges and universities to adopt an affirmative-consent policy during sexual assault investigations will likely re-appear next year.

State Sen. Dante Bartolomeo, D-Meriden, who co-chairs the Higher Education Committee, described the bill as good policy that was introduced too late in the session and failed to get discussion in the House. It received overwhelming Senate approval, with the exception of Sen. Joseph Markley, R-Southington, who questioned its merits on several fronts.

An affirmative-consent policy, often referred to as a “yes means yes” measure, would change the way schools investigate allegations of sexual assault by shifting the burden of proof to the accused to show the sexual activity was consensual. Schools such as the University of Connecticut and Yale University have affirmative-consent policies in place.
